Rent Renewal Disputes
Market rent advice for landlords and tenants at lease renewal.
Who we work with
Landlords, tenants and their legal advisers need market rent evidence when renewal terms require a rent determination or the parties differ on the appropriate rental basis.
When you need us
A renewal provision may leave the rent to be determined while other lease terms continue. The valuation must account for the specific terms governing that renewal.
What we do
Analyse comparable leases and relevant adjustments
Prepare a supported opinion of market rent
What you receive
The opinion provides evidence for renewal discussions and, where required, dispute resolution. Lease terms and valuation assumptions are clearly identified.
What we need to begin
Provide the executed lease, amendments, renewal notices, premises plans and relevant correspondence. Identify the rent review date, the questions in dispute and any agreed instructions from counsel on lease interpretation.
Related assignment
A related rental development appraisal examined anticipated income and operating assumptions for financing. It illustrates rental evidence within valuation, but is not a commercial lease renewal dispute. A directly comparable renewal assignment is not described in the published Experience entry.
Questions & answers
Why do you need the full lease?
The rent-setting provisions and other terms define the interest and assumptions being considered. A headline rent or short lease summary may omit conditions material to the analysis.
Are asking rents enough to determine market rent?
They are one possible source of information. Available transaction evidence and differences in terms, incentives, condition and location need consideration within the agreed scope.
Who resolves a disputed lease interpretation?
Legal advisers establish the interpretation or alternative instructions for the valuation. We explain how the specified assumptions affect the rent analysis.
