Ground Lease Arbitration
Valuation expertise for ground rent reviews and disputes.
Who we work with
Ground landlords, leaseholders and counsel need valuation expertise when a ground rent review depends on land value, a contractual formula or disputed valuation assumptions.
When you need us
Ground leases can involve longstanding agreements and property interests that require careful analysis when rent is reviewed.
What we do
Assess land value and relevant market evidence
Prepare valuation evidence for negotiation or arbitration
What you receive
Our experience includes advising landlords and tenants and serving in arbitrator appointments. The role and scope are established for each assignment.
What we need to begin
Provide the complete ground lease and amendments, review notices, relevant plans and earlier determinations or reports. Identify the review date, disputed provisions and whether the proposed role is adviser, expert or arbitrator.
Related assignment
A related land appraisal considered a parcel’s contribution to a wider development and made approval assumptions explicit. It demonstrates analysis of land value in context, but is not a ground lease arbitration. No arbitration result is claimed for this example.
Questions & answers
Why is the wording of the rent review clause important?
It establishes the valuation basis to be addressed, including the relevant interest and assumptions. Any disputed interpretation needs instructions from the parties or their legal advisers.
Are improvements always included in the valuation?
The instructed basis must establish what is included. We distinguish the land interest and any treatment of improvements required by the valuation instructions.
Is an arbitrator’s role the same as a party’s expert?
No. These are different appointments. The role, independence requirements and scope must be established before accepting the engagement; a party’s appraisal is not an arbitral decision.
